General terms and conditions

Preamble

The www.pmc.evasion.com site is owned in its entirety by PMC EVASION in its entirety, as well as all the accruing rights. Any reproduction, full or partial, is systematically subjected to the approval of the owners. Nevertheless, hypertext links to the site are allowed without specific permission.

We reserve the right to change the general terms and conditions of sale any time subject to displaying them on our site.

1. Approval of terms and conditions

The customer acknowledges having read these conditions of sale at the time of placing the order, and accepts them in full without reserve.

The present general terms and conditions of sale govern any contractual relations between PMC EVASION and the client, both parties agree to accept them unconditionally.

These general conditions of sale take precedence over all other conditions appearing in any other document, except where prior notice has been agreed in writing.

2. Products

Illustrating pictures are not contractual. PMC EVASION declines all responsibility for any errors that may appear. The products offered for sale by PMC EVASION are available in our warehouse.

3. Orders

The automatic ordering systems are considered to be legally binding with regards to the description , contents and date of order. PMC EVASION will confirm the acceptance of a customer order be means of an email at the provided email address. The order will only be considered accepted when the confirmation email has been sent. PMC EVASION reserves the right to cancel any customer order with whom there exists litigation relating to the payment of a previous order. Information enunciated by the purchaser, during the order process is considered correct and valid. In the case of an error, the seller cannot be held responsible for any loss resulting from the consequences of the error, especially with regards to delivery of goods.

4. Delivery

For export deliveries (outside of France) the customer agrees to be liable for all taxes, customs and excise duties and any other associated fees resulting from the importation of the product.

For French metropolitan deliveries, these will be performed by signed delivery using the French Post's Colissimo service, or by means of the “Relai Colis” network or by another delivery method resulting from the clients choice. Deliveries are made to the recipient specified by the client. In the case where the recipient is not available to take delivery, an alternative person must be specified by the client. Delays in the delivery do not give rise to any form of compensation.

Deliveries in the European Union will be made using Colissimo, and for the rest of the world, deliveries will be made by international postal service.

In the case of visible defects, the purchaser can request a right of return as set out in this document.

The following are considered “force majeur” and absolve the seller from his obligation to deliver: War, riots, civil disobedience, fire, floods, strikes, accidents and impossibility of being supplied. The goods always travel at risks and perils of the client. Always verify your shipment upon delivery. You can make use of a 48 hour period directly following delivery to make any claims regarding missing goods or deterioration of goods.

For logistical reasons, a shipment may be made in multiple instances; in which case no extra delivery charges will be made. If the client would like to be delivered in multiple locations, they must make multiple orders, each with corresponding delivery costs.

5. Refunds

The customer has a period of 7 days following the delivery of the product, to exercise his right of refund, in accordance with French law.

In the case of an exchange or a refund, the product must be returned in its original mint condtion such that is can be re-sold (this also applies to the packaging, accessories and leaflets) to:

If the client exercises his right of refund, PMC EVASION is held responsible for the refund of the total order sum paid by the client without any additional costs. If PMC EVASION considers the goods to have been returned in good condition, it will have up to 30 days to make the refund.

In case of financial year of the right of retraction, is kept in the refund of sums poured by the customer, without expenses, except for expenses back. Refund is owed for the delay maximum of 30 days at invoicing pointed out on the order form and if the turned product is considered correspondent by PMC EVASION.

6. Price

Prices are expressed in Euros.

The product prices displayed do not include the price of delivery.

The price shown in the order confirmation is the final price including all taxes and TVA for Euro Zone countries.

The price pointed out in the confirmation of order is the final price, expressed all taxes included and including Value Added Tax for France and countries of European Economic Community.

PMC EVASION reserves right to modify prices any time. The price shown on the site on the day of order is the one applicable to the client.

7. Payment

The price invoiced to the customer is the price shown on the order confirmation addressed to the customer by PMC EVASION.

Any sums becomes due on the day of order.

The payment will be made by use of an appropriate bank or by a check drawn on a French in Euros made out to :

The online PAYPAL module plays the role of a financial intermediary in a secured environment. Your credit card details are processed only by the secure PAYPAL servers, this is done in such a way that our online servers do not have to deal with your credit card details.

Orders generated by the customer will be considered fulfilled only when payment provider has approved the purchase. In case of refusal of the payment providers, the order will automatically be cancelled and the customer informed by email. Moreover, PMC EVASION reserves the right to refuse any order from a customer with whom there exists litigation.

8. Litigations

The present contract is subject to French law. PMC EVASION cannot be held responsible for damage of any kind, be it material, immaterial or bodily damage, which stems from an incorrect or inappropriate use of the product. In case of litigation regarding the application of the present contract, the client has the possibility to engage in a friendly resolution of the conflict, for example with help from a citizens advice bureau or a consumer protection agency of their own choice.

One is reminded that the out of court solution to settle litigation does not suspend the legal “bref délai” nor the length of the statutory guarantee.

One is reminded that as a general rule, and with the condition of the agreement of the courts, the execution of the details relative the contractual guarantee assumes that the buyer has honoured his financial commitments towards the seller.

Claims or complaints will always be taken seriously, benefit of the doubt will always be shown to the party which has raised the issue. In case of litigation, the client must will contact the firm in priority to request an amicable resolution.

It is hereby agreed that the court of LONS SAUNIER is the only one competent in resolving a dispute , no matter where the order was placed from nor where the delivery was to be made, and no matter what method of payment was used.

9. Guarantee

The customer is protected from hidden vices (Art 1625 and following, from the French Civil code). Provided that the purchaser can prove there is a hidden vice, the seller must legally put right all consequences (art 1641 and following of the civil code) ; if the purchaser applies to the courts, he must do so within the “bref délai” period as from the discovery of hidden vice (art 1648 of the civil code). 10. Lawful information

During the course of business, nominative information is gathered by the company for its own use. In accordance with the data protection law the company has registered with the (CNIL). The customer has a right of access, modification, correction and abolition of the data concerning him, that he can exercised via PMC EVASION. Besides, PMC EVASION promises not to divulge, sell, share or trade the details of their customers in any way or form.
